Protection of know-how or other technical information that is not patented is becoming a key consideration for many companies.  Nishimura & Asahi has a great deal of experience in advising clients on preparing relevant internal rules or other frameworks for protecting such information so that the information can fall within the scope of protected trade secrets under the Unfair Competition Prevention Act, and enable civil or criminal actions against any theft or misappropriation of such information.  Nishimura & Asahi also handles actions against the unauthorized use of brands as an indication of the business of a third party, or against the unauthorized sale of a third party’s goods that imitate the configuration of a brand, and other actions under the Unfair Competition Prevention Act.
