N&A successful in IP High Court cancellation of JPO trial decision (concerning a patent)

On May 30, 2011, the Intellectual Property High Court ("IPHC") cancelled the trial decision of the Japan Patent Office ("JPO") in favor of our client.

In this case our client, which is the most well-known Japanese plumbing products company, challenged the validity of the patent regarding a flush toilet owned by the premier US manufacturer of plumbing products.

The JPO dismissed the request of the client at the JPO trial, in which N&A did not represent the client. However, N&A represented the client in the IPHC proceeding, and the IPHC cancelled the JPO's decision on the ground of factual error.

Hiroshi Suga, Mitsuru Shishido and Yumi Ueda represented the client at the IPHC in seeking the cancellation of the JPO's trial decision.
